1. Introduction

This Terms of Service agreement outlines your rights and obligations when using our services. Please read it carefully.

2. Account and Data

You are solely responsible for the data and content stored in your hosting account and services. Regular backups are encouraged, though we also maintain periodic backups for disaster recovery purposes.

3. Service restrictions & abuse

Users are prohibited from doing the following on our services:

  • Hosting or distributing malicious or copyrighted content (DMCA)
  • Hosting pornographic content of any kind
  • Hosting content or data that may be related to gambling
  • Hosting network stresses, booters, botnets, or any other form of DDoS and network probing tools
  • Conducting spam activities using mail or other forms of communication. As a precaution, we have restricted outgoing emails and our customers require to go through a KYC Verification process to be whitelisted. In cases where we allow customers to use our servers for mailing, it's their responsiblity to maintain a healthy IP reputation and configure your mailing server using things like reverse DNS, DMARC, SPF. For more advance mail usage, we suggest an emailing provider. Failure to comply will result in email sending to be blocked.
  • Using software that is cracked or without proper license
  • Hosting Public proxies, proxies, TOR relays or TOR exit nodes
  • Hosting any form of cryptocurrency mining software
  • engaging in any form of illegal activity
  • attempting to gain unauthorized access to our systems
  • using our services to infringe on the rights of others

Failure to comply with these restrictions may result in the suspension or termination of your services. Customers are required to respond to abuse requests within 48 hours. These are usually sent over email. Failure to respond may result in services being suspended or terminated.

If you would like to report abuse or suspicious activity from a client, you may contact our abuse department via email at [email protected] or our online ticket system.

4. Payment and Billing

All our payments are processed in euro. If you are paying with a different currency, the payment will be converted to euro at the current exchange rate which may include a conversion fee.

Once provided, to prevent disruption to your Services, you agree to be billed automatically regularly via your credit card or other billing information you have on file with us. You are responsible for keeping your billing information up to date. We reserve the right to suspend or terminate your Services if your billing information is not up to date.

If you wish to cancel your Services, this must be done via our website before the end of the current billing period. You are liable for any accidental charges you incur due to the failure to cancel your Services.

All hosting accounts are set to auto-renew by default. Ensure your payment details are up-to-date to prevent any service interruptions. Refunds are subject to our discretion and may be provided on a prorated basis.

5. Account Eligibility & KYC

To comply with legal requirements and to ensure a safe and secure environment for all users, we reserve the right to conduct Know Your Customer (KYC) verification processes. This involves the collection and verification of personal information and documentation to confirm the identity of our users.

We are commited to ensuring privacy throughout this process and utilize Stripe Identity for processing this information. We will never store any of your personal information on our servers. We will only store a reference to the Stripe Identity verification. We will only use this information to comply with legal requirements and to ensure a safe and secure environment for all users.

If you're a new customer, you may be required to complete the KYC process before your account is activated. While we are processing your KYC, your account may be suspended. Existing customers may also be required to complete the KYC process if we are unable to verify your identity using the information you have provided. If you fail to complete the KYC process within 24 hours, your account may be terminated.

After the completion of the KYC process, the data on Stripe Identity will be deleted.

6. Support and Service Level Agreement

For specifics in regards to our Service Level Agreement, please refer to our SLA.

Our support team is available to assist you with any hosting-related queries. We aim to provide a response within a business day, though this may vary depending on the nature of the request and the volume of support tickets.

Our services are unmanaged, and we do not provide support for third-party applications or software. We will do our best to assist you with any issues you may encounter, but we cannot guarantee a resolution for all requests.

7. Right of withdrawal & Refund Policy

The Customer acknowledges their desire for the immediate full delivery upon order completion and understands that the provision of services begins promptly after an order is placed. To this effect, the Customer explicitly waives any right to withdrawal or cancellation for such services, with one exception as noted below.

Notwithstanding the above, the Customer is entitled to a refund if a request is made within 24 hours of service delivery. This limited right to a refund within 24 hours serves as an exception to the general waiver of withdrawal or cancellation rights. To exercise this right, the Customer must submit a refund request through a ticket for our billing department clearly stating the order details and the reason for the refund request.
